As your Select Counsel, we will help at each stage of purchasing your residential property, all the while giving you unlimited access to your attorney at a fixed price. There are two primary stages during the buying process where you may need legal advice: presenting an offer and closing the contract.

Presenting an Offer

First, we will help you in the initial stages as you draft a contract and present an offer. We will:

  • Provide you with unlimited consultation regarding the subject property and the proposed contract to purchase the property.
  • Draft or review the proposed purchase contract.
  • Draft any needed contract addenda.
  • If desired, represent you in negotiations with the seller.
  • Draft or review any inventory lists of personal property that you will be purchasing.
  • Advise you regarding your contract with a real property broker, if any, as desired.

Pricing

  • $500 per real property parcel for which you make a formal written offer to purchase.

Closing a Real Property Contract

After your offer has been accepted, we will assist you with the complicated task of closing on your property. We will:

  • Provide you with unlimited consultation regarding the property and the contract to purchase the property.
  • Draft or review the following documents, as needed: contract addenda, modifications, or extensions; easements, license agreements, or other necessary documents; contracts with home inspectors, surveyors, title companies, or other third parties; and deeds, bills of sale, and other conveyance documents, as permitted by the seller.
  • Coordinate on your behalf all third parties involved with the purchase contract, including brokers, loan officers, government agencies, surveyors, inspectors, title companies, homeowners associations, tenants, closing agents, and the like.
  • Keep you apprised of important dates and deadlines.
  • If desired, retain on your behalf and oversee a title search firm.
  • Review inspection reports, surveys, plats, homeowner or property owner association documents, other common interest community documents, relevant lease agreements, the title insurance commitment, and relevant documents affecting title.
  • Review all documents necessary to consummate the real property purchase contract, including seller’s property disclosure, broker’s acknowledgement of documents, escrow agreements, 1031 exchange-related documents, HUD-1 statements, all disclosures and forms required by or prepared by the closing agent, and the like.
  • Review all loan documents, including applications, notes, deeds of trust, and the like.
  • Review the title insurance policy, if any, after its issuance subsequent to closing.
  • If needed and schedule permitting, prepare the paperwork for and act as your attorney-in-fact to execute documents on your behalf.

Pricing

  • One half of one percent (0.5%) of the real property contract price, as determined at the initial execution of the contract (subject to a minimum of $2,500).
